Land deal case: Cop giving cheque of Rs 17 cr strange, says Gujarat High Court

Justice J B Pardiwala was hearing a quashing petition moved by inspector Rahul N Patel, who has been suspended after allegation of cheating while mediating a land deal worth Rs 35 crore surfaced earlier this year.

A single bench of the Gujarat High Court on Wednesday found it “strange” that a police inspector gave a cheque of Rs 17 crore as a guarantee while mediating a land deal between two private parties in Vadodara. The court remarked orally that prima facie it appears that the inspector was involved in the land deal.

Justice J B Pardiwala was hearing a quashing petition moved by inspector Rahul N Patel, who has been suspended after allegation of cheating while mediating a land deal worth Rs 35 crore surfaced earlier this year. He was posted in Vadodara Detection of Crime Branch (DCB).

The court refused to entertain the plea, following which lawyers representing the inspector sought not to press for the relief. Earlier, Patel’s lawyer argued that he gave the cheque of Rs 17 crore as a “good samaritan and as a guarantor” for the land deal. The lawyer also said that “the cheque was not to be used in any manner which ultimately was never used thus, it doesn’t amount to cheating.”

However, Justice Pardiwala remarked that “what role did he play as a guarantor… who permitted him?” Government prosecutor Mitesh Amin objected to the submission of Patel’s lawyer and said that departmental inquiry has been initiated against him and his name also figures as an accused. He added that following the inquiries, Patel has gone missing and has ducked several summons for his appearance. He said that earlier also the court had refused to entertain Patel’s anticipatory bail application.

Amin said Patel not only tried to meddle with the land dealing, but also took over the investigation of a complaint lodged by one of the parties who have been duped in the deal.
