MAMC rape case: Court convicts two

The girl was sexually assaulted by four youth at knife point on the terrace of the 'Khooni Darwaza' monument in New Delhi.

A Delhi court on Thursday convicted prime accused Rahul and his accomplice Amit in the Maulana Azad Medical College (MAMC) student gang-rape case,two years after the girl was sexually assaulted by four youth at knife point on the terrace of the ‘Khooni Darwaza’ monument in New Delhi.

Additional Sessions Judge Chander Shekhar,who held the duo guilty of the offence,fixed January 17 to hear arguments on the quantum of punishment to be awarded to them.

The court found Rahul and Amit guilty under Section 376 (2) (g) (gangrape),392 (for robbing mobile phone of victim),397 (robbery with attempt to cause death or grievous hurt),34 (common intention) of the Indian Penal Code (IPC) and relevant provisions of the Arms Act.

However,the court acquitted two others – Ashok of charges of harbouring the accused,and Mohan Lal,who was accused of dishonestly receiving stolen property.

Two minors aged 13 and 14 had pleaded guilty of the offence before the Juvenile Justice Board and they were sent to an Observation Home on September 6,2003 till they attained adulthood.

Immediately after the judgment,Rahul’s counsel Ajay Digpaul said that he would go for an appeal after studying the order.

He said the minimum punishment that the court would hand down was 10-year jail-term and the maximum,life imprisonment.

A week after the gruesome incident at the monument on Bahadur Shah Zafar Marg near ITO,Rahul was arrested by police on November 22,2002,based on leads provided by the girl,who claimed that the rapist bore a tattoo ‘Rahul’ on his fore arm.
