Bal Thackeray’s will: Doctor deposes, says Shiv Sena leader had chronic illnesses

Thackeray’s sons Uddhav and Jaidev have been locked in a legal battle over his will.

During the ongoing trial in the legal tussle between the sons of late Shiv Sena chief Bal Thackeray over his will, the family physician on Tuesday disclosed that the late Thackeray drank one-and-a-half glasses of wine twice a day. Thackeray’s sons Uddhav and Jaidev have been locked in a legal battle over his will. Jaidev has claimed that Thackeray was of unsound mind when he signed the will.

Jaidev’s lawyer cross-examined the family doctor who attested the late leader’s will. The family physician was asked if he remembered what time of the day late Thackeray drank wine. “At 12.30 afternoon and 9.30 pm,” said the doctor.

Justice Gautam Patel was, however, not amused when Jaidev’s lawyer asked if he drank regularly or everyday. “Next question. It is not prohibited. He was not doing anything illegal,” said the judge. The doctor was, however, allowed to answer Thackeray’s wine intake in a day. “A glass-and-a-half each time. Usually, less than a pint,” said the witness.

The cross-examination, which went on for a tad over a couple of hours, saw the witness being thrown at with a volley of questions. Jaidev’s lawyer further questioned the doctor if the late Thackeray was “severely ill” between 2007 and 2011. According to the doctor, however, they were “chronic illnesses”.

When asked if he had attested any other will apart from the one in question, the family doctor said he had done it once previously attested a will. “It was immediately prior to this one… I think it was in January 2011,” he said.

Justice Patel was also informed that Lilavati Hospital provided its medical staff when late Sena supremo attended two rallies in February 2012 at Bandra-Kurla complex. “Were you present. At either or both?” asked the lawyer to which the doctor, replied, “Yes. I was at both.”

Late Thackeray’s family doctor also said the doctors and staffers from the hospital accompanied him since 2007. The witness, however, was present on request or when he was not committed to other tasks. The doctor also accompanied Thackeray when he attended Dussehra rally in 2011 and traveled to Pune when cartoonist R X Laxman had passed away.

Thackeray’s sons Uddhav and Jaidev are locked in a legal battle over their father’s will. Udhhav filed a probate petition to get the will certified by the high court, but Jaidev contested it, saying that according to the will, he would not get anything. The court in one of the earlier hearings said that it would be in the interest of both parties to avoid a situation that may arise as a result of the proceedings.
