South civic body objects to Delhi assembly summoning its chief

The SDMC passed a resolution and its members stated that the House committee went “beyond its mandate” in its treatment of a senior corporation staff that attended Tuesday’s meeting.

The standing committee of the South Delhi Municipal Corporation Friday objected to the summoning of SDMC commissioner Puneet Goel by the Question and Reference Committee of Delhi assembly over a reference forwarded by MLA Sourabh Bhardwaj.

The Delhi assembly committee had on Tuesday recommended initiation of contempt proceedings of the House against Goel and principal secretary (UD) for not appearing before the panel in connection with the civic body “stalling” development work being done through the MLA-LAD fund.

The SDMC panel’s chairman Shailender Singh Monti said the Speaker had only referred to unstarred question No. 19 raised by MLA Bhardwaj before the committee. “Prima facie, it is apparent that the committee is exceeding its jurisdiction and enhancing the scope of reference. The SDMC officers are not only being repeatedly called but are also being harassed by Bhardwaj,” he said.

Additional Commissioner Meeta Singh, along with CLO Rajneesh Bansal and engineer-in-chief Umesh Sachdeva of SDMC appeared before the House panel on Tuesday.

The chairman noted that all the details related to the unstarred question had been provided by SDMC repeatedly as desired by Bhardwaj. He added that “Bhardwaj, who is a member of the committee, is the judge of his own cause, which is violative of principles of natural justice & rule 161. In fact, Bhardwaj cannot be member of the committee in cases where he has interest”.

The release of funds was subject to 21 conditions, of which number 13, 18 & 19 clearly stated that similar nature of work “should be treated as a single project and the executing agency should follow the provisions of GFR and CPWD work manual”.

The committee stated that the engineering department had also completed 6 of 11 projects under MLA-LAD.

Leader of the House, Subhash Arya, and leader of opposition, Farhad Suri, said AAP MLAs have been recommending similar works in the past, which have already been completed by SDMC.

“If they have any intention of making use of their fund on SDMC’s properties, they must compel the government to release the requested funds on education, community centres and hospitals,” Arya said.
